PLEASE READ THESE TERMS OF SERVICE CAREFULLY.

1. Introduction and Acceptance

Welcome to YVR 3D (the "Site"), a digital manufacturing platform operated by YVR Technologies Indonesia ("YVR 3D," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "Customer") and YVR Technologies Indonesia regarding your access to and use of our website, mobile applications, and our on-demand 3D printing and manufacturing services (collectively, the "Services"). By accessing the Site, uploading 3D files, requesting a quote, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a company, organization, or other legal entity, you represent that you have the authority to bind such entity to these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICES.

2. Definitions

To ensure clarity, the following terms used in this agreement shall have the meanings defined below:

  • "3D Model" or "Digital File" refers to the digital design files (e.g., .STL, .OBJ, .STEP) uploaded by the User for the purpose of manufacturing.
  • "Part" or "Product" refers to the physical object manufactured by YVR 3D based on the User's 3D Model.
  • "Order" refers to a request for Services submitted by the User, including the upload of files, selection of materials, and payment of fees.
  • "Quote" refers to the estimated cost and turnaround time provided by YVR 3D for a specific Order.
  • "Intellectual Property Rights" means all patent rights, copyright rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights, and other intellectual property rights as may now exist or hereafter come into existence.

3. Account Registration and Security

3.1 Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use our Services. By using the Site, you warrant that you meet this age requirement. If you are under 18, you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

3.2 Account Creation

To access certain features, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.3 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. YVR 3D will not be liable for any loss or damage arising from your failure to comply with these security obligations.

4. The Ordering Process

4.1 Uploading and Quoting

The ordering process begins when you upload a Digital File to our Site. Our automated systems or engineering team will generate a Quote based on factors including, but not limited to, material volume, machine time, material type, and post-processing requirements.

4.2 Quote Validity

Quotes provided via the Site are estimates. While we strive for accuracy, YVR 3D reserves the right to amend a Quote prior to production if:

  • The Digital File is found to be corrupted or unprintable.
  • The design requires significant manual repair or modification.
  • There is a manifest error in the pricing algorithm.
  • Material costs have fluctuated significantly (though this is rare for confirmed orders). If a price change is required, we will notify you, and you will have the option to accept the new price or cancel the Order.

4.3 Order Acceptance

An Order is considered "Accepted" only when:

  1. You have submitted the Order;
  2. Payment has been verified and received; and
  3. We have sent you an order confirmation email. We reserve the right to decline any Order at our sole discretion, including but not limited to Orders involving Prohibited Content (see Section 6).
  4. We also reserve the right to cancel and refund an Order post-payment if technical analysis reveals the 3D model carries a high risk of print failure or damage to our machinery.

4.4 Modifications and Cancellations

  • Before Production: You may request to cancel or modify an Order before the status changes to "In Production." A cancellation fee may apply to cover administrative costs or material allocation.
  • During Production: Once an Order status is "In Production" or "Printing," it cannot be cancelled or modified.Custom manufacturing renders the materials and labor dedicated to your Order non-recoverable.

5. Intellectual Property Rights

5.1 User Ownership

You retain full ownership and copyright of any 3D files you upload. YVR 3D claims no intellectual property rights over your designs. Your upload of a file to our platform does not transfer any ownership rights to us.

5.2 Limited License to YVR 3D

By uploading your 3D Models to the Site, you grant YVR 3D alimited, non-exclusive, worldwide, royalty-free license solely to use the files for the purpose of quoting, manufacturing, and fulfilling your order. This license includes the right to:

  1. Process: Use slicing software to prepare the file for printing.
  2. Manufacture: Print the physical object using our equipment.
  3. Display (Internal): Generate internal thumbnails for order tracking and history.
  4. Legal Compliance: Comply with legal obligations if required.

We will not sell, rent, share, or distribute your 3D Models to third parties for their independent use without your express written consent.

5.3 Infringement of Third-Party Rights

You represent and warrant that your 3D Models do not infringe upon the intellectual property, privacy, or publicity rights of any third party. If YVR 3D receives a notice alleging that your content infringes on a third party's rights, we may, in our sole discretion, remove or disable access to the content and cancel your Order.

6. Prohibited Content and Activities

6.1 Prohibited Items

YVR 3D adheres to strict ethical and legal safety standards. You are strictly prohibited from uploading designs for, or ordering the manufacture of:

  • Firearms and Weapons: Any functional firearm, replica firearm that could be mistaken for a real weapon, ammunition, silencers, bump stocks, or any component essential to the function of a weapon.
  • Bladed Weapons: Switchblades, gravity knives, or concealed bladed weapons prohibited by Indonesian law.
  • Illegal Devices: Skimmers for credit cards, lock-picking tools, keys for critical infrastructure, or drug paraphernalia.
  • Obscene Content: Sexually explicit material or content that promotes hate speech, violence, or discrimination based on race, religion, gender, or sexual orientation.

6.2 Right to Refuse

YVR 3D reserves the right to inspect all Digital Files and refuse to manufacture any Part that we believe violates this Policy or applicable law. In such cases, we will cancel the Order and issue a refund, less any administrative costs incurred. We may also report such attempts to law enforcement authorities if required by law.

7. Manufacturing Standards and Disclaimers

7.1 Nature of Additive Manufacturing

You acknowledge that 3D printing (Additive Manufacturing) is a layer-by-layer manufacturing process. The physical properties and visual appearance of Parts may differ from those manufactured by traditional methods (e.g., injection molding).

  • Layer Lines: Visible layers are an inherent characteristic of FDM/FFF and, to a lesser extent, SLA printing. These are not considered defects.
  • Support Structures: Parts may require support structures during printing. While we remove these supports, small marks, nibs, or discoloration may remain on the surface where supports were attached.
  • Surface Finish: Unless a specific post-processing service (e.g., sanding, painting) is purchased, parts are shipped "as-printed."

7.2 Tolerances

Unless otherwise explicitly agreed in writing (e.g., via a technical drawing attached to a commercial contract), YVR 3D guarantees standard commercial tolerances for FDM printing of approximately ±0.2mm or ±0.5% of the dimension, whichever is greater. You acknowledge that thin walls (under 0.8mm), long overhangs, or complex geometries may deviate further from these tolerances.

7.3 Material Properties

Information regarding material properties (e.g., heat resistance, tensile strength) provided on the Site is based on data from material manufacturers. However, final part strength depends on geometry, print orientation, and infill percentage. We do not guarantee that any Part will satisfy a specific mechanical requirement unless verified by our engineering team in a separate consulting agreement.

7.4 Fitment and Design Responsibility

YVR 3D is a manufacturing service, not a design firm. You are solely responsible for the design of your Part. We are not responsible for:

  • Parts that do not fit together due to design errors (e.g., lack of clearance/tolerance in the CAD file).
  • Parts that break due to insufficient wall thickness designed by the User.
  • Typographical or scaling errors in the uploaded file.

8. Payment and Taxes

8.1 Pricing

All prices are displayed in Indonesian Rupiah (IDR) unless otherwise noted. Prices are subject to change at any time without notice, but such changes will not affect Orders that have already been Accepted.

8.2 Taxes

You are responsible for paying all applicable sales, use, value-added (VAT/PPN), or other taxes or duties associated with your Order. If legally required, YVR 3D will collect these taxes at checkout and remit them to the appropriate tax authorities.

8.3 Payment Methods

We accept payment via bank transfer, credit card, and other digital payment methods as indicated on the Site. You represent that you are authorized to use the payment method provided.

9. Shipping and Delivery

9.1 Lead Times

Turnaround times listed on the Site (e.g., "2-3 Days") are estimates based on average production capacity. They are not guaranteed delivery dates. Delays may occur due to machine maintenance, print failures requiring reprints, high order volume, or material shortages.

9.2 Shipping Terms

Unless otherwise agreed, all shipments are made FOB (Free on Board) Shipping Point. This means that title to and risk of loss for the Products pass to you upon our delivery of the Products to the carrier (e.g., JNE, GoSend, DHL).

9.3 Inspection upon Delivery

You must inspect the Products within three (3) days of receipt. If you discover a defect or a shortage, you must notify YVR 3D immediately. Failure to notify us within this period constitutes acceptance of the Products "as is."

10. Warranty and Returns

10.1 Limited Warranty

YVR 3D warrants that the Parts will substantially meet the specifications of the Digital File provided (subject to the tolerances in Section 7.2) and will be free from material defects in workmanship at the time of delivery.

10.2 Remedy

In the event of a breach of the above warranty, your sole and exclusive remedy, and our sole liability, is for YVR 3D to, at its option:

  1. Reprint the defective Part at no additional cost; or
  2. Refund the portion of the purchase price attributable to the defective Part.

10.3 Exclusions

This warranty does not apply to:

  • Defects resulting from your specific design choices (e.g., walls too thin).
  • Damage caused by misuse, accident, modification, or improper installation after delivery.
  • Dissatisfaction with the aesthetic "look and feel" inherent to the chosen manufacturing technology (e.g., visible layer lines).

11. Indemnification

You agree to indemnify, defend, and hold harmless YVR Technologies Indonesia, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from:

  1. Your violation of these Terms;
  2. Your use of the Services;
  3. Your violation of any rights of another party; or
  4. Any claim that your User Content caused damage to a third party or infringed upon the Intellectual Property Rights of a third party.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL YVR 3D BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES), ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICES OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO YVR 3D FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

13. Safety Warnings

13.1 Not for Critical Use

Unless expressly certified in writing, Parts manufactured by YVR 3D are not designed, tested, or intended for use in:

  • Medical devices or implants.
  • Safety-critical applications where failure could result in injury or death.
  • Aerospace or aviation applications.
  • Contact with food or beverages. Standard 3D printing materials (PLA, PETG, Resin) are NOT food safe due to the risk of bacterial growth between layer lines. YVR 3D does not recommend any printed part for direct food contact.

You assume full responsibility for the testing and validation of any Part intended for such uses.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms and any action related thereto will be governed by the laws of the Republic of Indonesia without regard to its conflict of laws provisions.

14.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by the courts located in North Jakarta (Jakarta Utara), Indonesia. You hereby consent to the personal jurisdiction and venue of these courts.

15. General Provisions

15.1 Force Majeure

YVR 3D shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor, or materials.

15.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.

15.3 Entire Agreement

These Terms, together with our Privacy Policy and any specific commercial agreements signed by both parties, constitute the entire agreement between you and YVR 3D regarding the Services and supersede all prior agreements or understandings.

15.4 Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of these Terms and, where appropriate, by email. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
